TERMS AND CONDITIONS
1. Promoter
The Flinders University Student Association (FUSA), ABN 65 542 596 200, located at Sturt Road, Bedford Park SA, is conducting the Student Council Survey (“Competition”).
2. Competition Eligibility and Entry
– The Competition is open to all students currently enrolled at Flinders University who hold a valid student ID number and are enrolled in at least one topic.
– Employees and staff of Flinders University are not eligible to enter.
– Competition entry is free.
– By entering this Competition, all Entrants are deemed to have accepted these Terms and Conditions.
3. Competition Period
– The Competition commences at 9.00 am on Monday, 20 February 2025 and concludes at 5.00 pm on Friday, 21 March 2025 (ACST).
– Entries must be received no later than 5.00 pm on Friday, 21 March 2025. Late entries will not be accepted.
4. How to Enter
– Participants must submit their entries online via JotForm (or other designated platform).
– Only one (1) Entry per person is permitted.
– Once an Entry is submitted, no changes to or withdrawal of that Entry will be permitted.
5. Prize(s)
– There are two (2) AUD $100 gift cards to be awarded, each to a separate winner.
– The total value of all prizes is AUD $200.
– The Prize(s) are non-transferable and cannot be exchanged or taken for cash.
– Prize(s) must be accepted by the winners subject to any conditions, restrictions, or expiry/validity dates applicable to them. Winners are solely responsible for complying with any such prize conditions and expiry dates.
6. Winner Selection and Notification
– Entrants’ names will be collated after the closing date and time.
– Two (2) winners will be selected at random from the list of Entrants.
– The winners will be notified via their Flinders University student email account on Tuesday, 25 March 2025.
– The Promoter’s decision regarding the outcome of the Competition is final. No correspondence will be entered into.
7. Claiming the Prize
– The Promoter will provide the winners with particulars of how the prize(s) are to be delivered or collected.
– Winners have fourteen (14) days from the date of notification to claim their prize.
– If a winner does not contact the Promoter within that time period to claim their prize, or is otherwise unable/unwilling to claim their prize for any reason, the prize will be forfeited and dealt with at the Promoter’s discretion.
8. Changes to Contact Details
– Entrants are responsible for keeping the Promoter informed of any changes to their contact details during the Competition period and after the draw.
9. Disqualification
– The Promoter reserves the right in its sole discretion to disqualify any Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions or engaged in unlawful or other improper misconduct that jeopardises the fair and proper conduct of the Competition.
10. Liability
– To the extent permitted by law, the Promoter is not responsible or liable for:
1. Inaccurate or incorrect transcription of Entry information;
2. Unauthorised human intervention in any part of the Competition;
3. Electronic or human error which may occur in the administration of the Competition.
– The Promoter shall not be liable for any loss or damage whatsoever (including direct or consequential loss) or any personal injury suffered or sustained in connection with the taking or use of a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
– The Promoter makes no warranties or representations about the fitness for purpose or suitability of a prize and is not responsible for the quality or fitness for purpose of the prize. If liability under terms implied by legislation cannot be excluded, the Promoter’s liability is limited to re-supplying the relevant goods or services comprising the prize or paying the cost of replacing them.
11. Privacy
– By entering this Competition, Entrants consent to the Promoter collecting, using, and disclosing any information (including personal details) contained in their Entry for the Promoter’s marketing, promotional, student services, or recruitment purposes in accordance with the relevant collection statement.
– The Entrant grants a perpetual, non-transferable, royalty-free licence to the Promoter to use, publish, and communicate any part or all of this information (in original or modified form) for the above purposes.
– The Promoter’s privacy policy can be viewed at www.flinders.edu.au/privacy. It contains information about how Entrants can complain about a privacy breach, how the Promoter will deal with such a complaint, how Entrants can seek access to or correction of the personal information the University holds about them, and how they can opt out of receiving direct marketing messages.
12. Media Release
– For this particular Competition, the Promoter does not plan to take photos or record the winners for promotional purposes.
– If the Promoter later decides to engage in any photography, filming, or recording, the Promoter will first obtain additional consent from the winners.
13. Promoter’s Rights
– The Promoter reserves the right to modify, suspend, cancel, or terminate the Competition if, for any reason, the Competition is not capable of running as planned, including causes beyond the control of the Promoter.
– The Promoter also reserves the right to request the winners provide proof of identity and/or proof of entry eligibility in order to claim a prize.
14. Governing Law
– These Terms and Conditions are governed by the laws of South Australia, and any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in South Australia prescribed in Regulation 30 of the Lottery and Gaming Regulations 2008.
All advertisements for the Competition must contain any information prescribed by the Lottery and Gaming Regulations or any other relevant laws.
